1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern access to and use of the website operated by In Tenebris Ultrasound LLC (“In Tenebris Ultrasound,” “Company,” “we,” “us,” or “our”), including its educational materials, images, graphics, videos, downloadable resources, publications, courses, presentations, and other content (“Content”).
Users must create an account to access certain educational resources. By creating an account, checking the box indicating agreement to these Terms, purchasing Content, or otherwise using portions of the website requiring acceptance of these Terms, you agree to be bound by them.
If you do not agree to these Terms, you should not create an account, purchase Content, or access portions of the website conditioned upon acceptance of these Terms.
2. Educational Purpose
In Tenebris Ultrasound was created to make high-quality ultrasound and sonography education more accessible to students and professionals.
We believe that access to knowledge and ownership of the materials used to communicate that knowledge are separate concepts. Accordingly, much of our Content may be provided free of charge, while certain resources may require payment.
Providing Content without charge does not place that Content in the public domain, waive copyright protection, or grant unrestricted rights to reproduce or redistribute it.
3. Ownership and Intellectual Property
Unless otherwise identified, original Content created by In Tenebris Ultrasound LLC is owned by or licensed to In Tenebris Ultrasound LLC and is protected by applicable copyright and other intellectual-property laws.
This may include, without limitation:

- original ultrasound images and image collections;
- illustrations, diagrams, graphics, and infographics;
- educational handouts and worksheets;
- presentations;
- photographs;
- videos and other audiovisual materials;

- downloadable resources;
- educational organization, commentary, and explanatory materials; and
- other original works displayed or distributed through the website.
Copyright ownership remains with In Tenebris Ultrasound LLC or the applicable identified copyright owner. Access to Content, whether free or paid, does not transfer copyright ownership to the user.
Nothing in these Terms is intended to claim ownership of medical facts, scientific principles, procedures, terminology, ideas, or other information that is not subject to copyright protection.
4. Free Educational Content
We encourage reasonable use of designated free Content for legitimate personal and noncommercial educational purposes.
Unless otherwise stated on a particular resource, a user may:
- view and study free Content for personal educational purposes;
- reference the information contained in free Content;
- share a reasonable and limited amount of free Content for legitimate, noncommercial educational purposes when In Tenebris Ultrasound LLC and/or the identified creator remains clearly credited;

Providing attribution does not, by itself, authorize an otherwise prohibited use.
6. Educational and Institutional Use
We want educators to be able to use our work in legitimate educational settings while preserving the value of the work itself.
Students, instructors, sonographers, healthcare professionals, schools, colleges, universities, nonprofit organizations, and other educational users are encouraged to contact us when they would like to use Content beyond the permissions provided by these Terms.
We may grant additional permission, including permission for classroom, institutional, presentation, training, or nonprofit use, on a case-by-case basis.
Permission must be obtained in writing when required by these Terms.
Commercial educational use, including use by a business or individual charging for courses, continuing education, training, subscriptions, consulting, publications, or similar services, requires prior written permission unless expressly authorized elsewhere on the website.
7. Paid Content
Certain Content may require payment.
Unless otherwise expressly stated, purchasing paid Content grants the purchaser a limited, personal, nonexclusive, nontransferable license to access and use that Content for the purchaser’s own educational purposes.
Purchasing Content does not transfer copyright ownership.

Institutional or group licensing may be available separately.
8. User Accounts
Users may be required to create a free account to access Content.
Users are responsible for maintaining the confidentiality of their login credentials and for activity occurring through their accounts.
Accounts are intended for individual use unless an institutional or group arrangement expressly provides otherwise.
Users may not share account credentials for the purpose of allowing another person to access Content that would otherwise require that person to register or purchase access.
We reserve the right to restrict or terminate access when we reasonably believe an account is being used to violate these Terms, subject to applicable law and any contractual obligations.
9. Third-Party Content and Attribution
The website may reference, link to, discuss, display, or incorporate materials created by third parties.
Third-party Content remains the property of its respective copyright owner and is not claimed as original Content of In Tenebris Ultrasound LLC merely because it appears on or is referenced by the website.

A citation or attribution does not necessarily indicate ownership by In Tenebris Ultrasound LLC.

15. No Guarantee of Professional or Educational Outcomes
Use of the website or Content does not guarantee passage of a certification or registry examination, employment, professional competency, clinical outcomes, continuing-education credit, or any particular educational result.
Users remain responsible for verifying examination requirements, credentialing standards, continuing-education requirements, and other professional obligations with the appropriate governing organization.

In Tenebris Ultrasound LLC is a Wisconsin entity. Please advise regarding Wisconsin governing law, appropriate venue, informal dispute resolution, mediation, arbitration versus litigation, class-action provisions if appropriate, and enforceability of any pre-suit notice requirement.
25. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions should remain in effect to the fullest extent permitted by law, and the invalid provision should be modified or interpreted as necessary to most closely accomplish its intended lawful purpose.
26. No Waiver
Failure to enforce a provision of these Terms on one occasion does not constitute a waiver of the right to enforce that provision or another provision in the future.
