TERMS AND CONDITIONS

In Tenebris Ultrasound LLC
Effective Date: August 30, 2026
Last Updated: August 30, 2026

1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern access to and use of the website operated by In Tenebris Ultrasound LLC (“In Tenebris Ultrasound,” “Company,” “we,” “us,” or “our”), including its educational materials, images, graphics, videos, downloadable resources, publications, courses, presentations, and other content (“Content”).

Users must create an account to access certain educational resources. By creating an account, checking the box indicating agreement to these Terms, purchasing Content, or otherwise using portions of the website requiring acceptance of these Terms, you agree to be bound by them.

If you do not agree to these Terms, you should not create an account, purchase Content, or access portions of the website conditioned upon acceptance of these Terms.

2. Educational Purpose

In Tenebris Ultrasound was created to make high-quality ultrasound and sonography education more accessible to students and professionals.

We believe that access to knowledge and ownership of the materials used to communicate that knowledge are separate concepts. Accordingly, much of our Content may be provided free of charge, while certain resources may require payment.

Providing Content without charge does not place that Content in the public domain, waive copyright protection, or grant unrestricted rights to reproduce or redistribute it.

3. Ownership and Intellectual Property

Unless otherwise identified, original Content created by In Tenebris Ultrasound LLC is owned by or licensed to In Tenebris Ultrasound LLC and is protected by applicable copyright and other intellectual-property laws.

This may include, without limitation:

  • written educational materials;
  • original ultrasound images and image collections;
  • illustrations, diagrams, graphics, and infographics;
  • educational handouts and worksheets;
  • presentations;
  • photographs;
  • videos and other audiovisual materials;
  • website text and design elements;
  • downloadable resources;
  • educational organization, commentary, and explanatory materials; and
  • other original works displayed or distributed through the website.

Copyright ownership remains with In Tenebris Ultrasound LLC or the applicable identified copyright owner. Access to Content, whether free or paid, does not transfer copyright ownership to the user.

Nothing in these Terms is intended to claim ownership of medical facts, scientific principles, procedures, terminology, ideas, or other information that is not subject to copyright protection.

4. Free Educational Content

We encourage reasonable use of designated free Content for legitimate personal and noncommercial educational purposes.

Unless otherwise stated on a particular resource, a user may:

  • view and study free Content for personal educational purposes;
  • reference the information contained in free Content;
  • share a reasonable and limited amount of free Content for legitimate, noncommercial educational purposes when In Tenebris Ultrasound LLC and/or the identified creator remains clearly credited;
  • share links directing others to the original Content; and
  • use limited free Content in an educational setting when proper attribution is maintained and the use does not substitute for purchasing or accessing a substantial collection of our materials.

Attribution should not be removed, obscured, cropped out, or altered. Existing copyright notices, watermarks, logos, source information, and identifying information must remain intact.

Free access does not constitute permission to reproduce substantially all of the Content, create a duplicate or competing educational library, or commercially exploit the Content.

5. Uses Requiring Permission

Unless otherwise expressly permitted in writing, users may not:

  • claim our Content as their own;
  • remove or conceal authorship, attribution, copyright notices, logos, or watermarks;
  • sell or resell our Content;
  • incorporate our Content substantially into a product, book, course, subscription, website, application, presentation library, or other commercial offering;
  • charge others specifically for access to our Content;
  • reproduce or aggregate a substantial portion of our educational library;
  • systematically download, scrape, copy, archive, or collect Content for redistribution;
  • upload our Content to another website, file-sharing service, repository, artificial-intelligence dataset, content database, or similar collection for redistribution or commercial exploitation;
  • sublicense our Content;
  • imply that In Tenebris Ultrasound LLC endorses, sponsors, or is affiliated with another person or organization without authorization; or
  • otherwise use our Content in a manner that substitutes for obtaining authorized access to the original Content.

Providing attribution does not, by itself, authorize an otherwise prohibited use.

6. Educational and Institutional Use

We want educators to be able to use our work in legitimate educational settings while preserving the value of the work itself.

Students, instructors, sonographers, healthcare professionals, schools, colleges, universities, nonprofit organizations, and other educational users are encouraged to contact us when they would like to use Content beyond the permissions provided by these Terms.

We may grant additional permission, including permission for classroom, institutional, presentation, training, or nonprofit use, on a case-by-case basis.

Permission must be obtained in writing when required by these Terms.

Commercial educational use, including use by a business or individual charging for courses, continuing education, training, subscriptions, consulting, publications, or similar services, requires prior written permission unless expressly authorized elsewhere on the website.

7. Paid Content

Certain Content may require payment.

Unless otherwise expressly stated, purchasing paid Content grants the purchaser a limited, personal, nonexclusive, nontransferable license to access and use that Content for the purchaser’s own educational purposes.

Purchasing Content does not transfer copyright ownership.

Paid Content may not be:

  • shared with individuals who have not purchased or otherwise been granted access;
  • posted publicly;
  • uploaded to shared drives, group repositories, course-sharing websites, social-media groups, or file-sharing services;
  • copied or distributed to coworkers, classmates, students, or other third parties except where expressly permitted;
  • resold or sublicensed;
  • incorporated into another commercial product or service without written permission; or
  • accessed through shared account credentials.

Institutional or group licensing may be available separately.

8. User Accounts

Users may be required to create a free account to access Content.

Users are responsible for maintaining the confidentiality of their login credentials and for activity occurring through their accounts.

Accounts are intended for individual use unless an institutional or group arrangement expressly provides otherwise.

Users may not share account credentials for the purpose of allowing another person to access Content that would otherwise require that person to register or purchase access.

We reserve the right to restrict or terminate access when we reasonably believe an account is being used to violate these Terms, subject to applicable law and any contractual obligations.

9. Third-Party Content and Attribution

The website may reference, link to, discuss, display, or incorporate materials created by third parties.

Third-party Content remains the property of its respective copyright owner and is not claimed as original Content of In Tenebris Ultrasound LLC merely because it appears on or is referenced by the website.

Where appropriate, we endeavor to identify sources, provide attribution, obtain permission or licenses when required, and/or use third-party materials pursuant to other rights or limitations recognized by applicable law.

A citation or attribution does not necessarily indicate ownership by In Tenebris Ultrasound LLC.

Users wishing to reuse third-party Content should determine the applicable rights and obtain permission from the relevant copyright owner when necessary.

10. Copyright Concerns and Good-Faith Resolution

In Tenebris Ultrasound LLC respects the intellectual-property rights of others and wants to resolve legitimate copyright concerns promptly and cooperatively.

If you believe Content appearing on this website infringes a copyright that you own or are authorized to enforce, we ask that you contact us at:

Copyright Contact: sonographycoah@gmail.com

Please provide, to the extent reasonably available:

  1. identification of the copyrighted work at issue;
  2. identification and location of the material on our website that you believe infringes that work;
  3. your name and contact information;
  4. an explanation of your ownership of or authority concerning the copyrighted work;
  5. the nature of your concern; and
  6. any additional information that may help us investigate the matter.

Upon receiving a good-faith copyright concern, we intend to investigate it reasonably and promptly.

Depending on the circumstances, resolution may include correcting or adding attribution, obtaining or confirming permission, modifying Content, replacing Content, removing Content, restricting access, or reaching another mutually agreeable resolution.

11. Opportunity for Informal Resolution

To the extent permitted by applicable law, the parties are encouraged to attempt in good faith to resolve disputes concerning Content, copyright, licensing, or use of the website through direct written communication before initiating litigation.

The purpose of this provision is to provide both parties a reasonable opportunity to understand the concern and, where possible, resolve it without unnecessary legal proceedings.

Nothing in this section is intended to eliminate or unlawfully restrict any right or remedy that cannot legally be waived or limited.

12. DMCA Copyright Procedure

Any formal DMCA procedure adopted by the Company will supplement, rather than replace where legally appropriate, our preference for cooperative resolution of copyright concerns.

13. User-Submitted Content

Users retain any rights they hold in original materials they submit.

By voluntarily submitting Content for publication or use on the website, a user grants In Tenebris Ultrasound LLC only those rights reasonably necessary to provide the applicable service, subject to any additional terms presented when the material is submitted.

Users may not knowingly submit Content that infringes another person’s intellectual-property rights.

14. Educational and Medical Disclaimer

Content provided by In Tenebris Ultrasound LLC is intended for educational and informational purposes.

It is not intended to replace professional education, credentialing requirements, institutional policies, manufacturer instructions, clinical protocols, physician interpretation, independent professional judgment, or applicable standards of care.

Medical and sonographic information evolves over time. Although reasonable efforts may be made to provide accurate and useful educational information, we do not guarantee that every item of Content will remain complete, current, or applicable to every clinical situation.

Users are responsible for exercising their own professional judgment and complying with applicable laws, regulations, professional standards, institutional policies, and scope-of-practice requirements.

Nothing on this website establishes a healthcare provider-patient relationship.

15. No Guarantee of Professional or Educational Outcomes

Use of the website or Content does not guarantee passage of a certification or registry examination, employment, professional competency, clinical outcomes, continuing-education credit, or any particular educational result.

Users remain responsible for verifying examination requirements, credentialing standards, continuing-education requirements, and other professional obligations with the appropriate governing organization.

16. Third-Party Links and Resources

The website may contain links to third-party websites, publications, research, resources, products, or services for educational or reference purposes.

Unless expressly stated otherwise, providing a link does not constitute ownership, sponsorship, endorsement, or control of the third-party resource.

We are not responsible for the content, availability, privacy practices, terms, or accuracy of third-party websites.

17. Purchases, Refunds, and Access

Prices, payment terms, access periods, and refund policies applicable to paid Content will be disclosed at or before purchase.

18. Suspension or Termination

We may suspend or terminate a user’s access to some or all services when reasonably necessary to address fraud, security concerns, unlawful conduct, unauthorized redistribution, account sharing, intellectual-property infringement, or material violations of these Terms.

Where appropriate and practicable, we may provide notice or an opportunity to correct a violation before termination.

Termination of access does not transfer, extinguish, or otherwise alter intellectual-property ownership.

19. Privacy

Collection and use of personal information are governed by our Privacy Policy.

Because account registration is required, the Privacy Policy should explain what information is collected, why it is collected, how it is used, how long it is retained, what service providers may receive it, and what rights users may have concerning their information.

20. Changes to These Terms

We may update these Terms periodically.

When material changes are made, users may be notified and/or required to affirmatively accept updated Terms where required by law or where we determine renewed consent is appropriate.

The applicable version and effective date should be maintained as part of the Company’s records.

21. Disclaimer of Warranties

As required under law.

22. Limitation of Liability

As required by law.

23. Indemnification

As required by law.

24. Dispute Resolution and Governing Law

These Terms will be governed by the laws designated in the final version of this agreement, without regard to conflict-of-law principles where appropriate.

In Tenebris Ultrasound LLC is a Wisconsin entity. Please advise regarding Wisconsin governing law, appropriate venue, informal dispute resolution, mediation, arbitration versus litigation, class-action provisions if appropriate, and enforceability of any pre-suit notice requirement.

25. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions should remain in effect to the fullest extent permitted by law, and the invalid provision should be modified or interpreted as necessary to most closely accomplish its intended lawful purpose.

26. No Waiver

Failure to enforce a provision of these Terms on one occasion does not constitute a waiver of the right to enforce that provision or another provision in the future.
